Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the SchoolCam mobile application, website, and related services (collectively, the “Service”) provided by Bitwise Software, SL (“Bitwise Software”, “SchoolCam”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
Description of the Service
SchoolCam is designed for schools, school districts, and educational institutions to capture and organize school-related photos and videos.
The Service allows authorized users to:
• Capture photos and videos within the app
• Automatically upload those files directly to a Google Drive account selected and authorized by the school
• Organize media within folders controlled by the school
Important:
SchoolCam does not store photos or videos on Bitwise Software servers. Media files are uploaded directly from the mobile device to the school’s designated Google Drive account. Bitwise Software does not host, copy, or maintain student photos on its own infrastructure.
The school or institution determines how photos are stored, shared, retained, and managed within its Google Workspace environment.
Eligibility and Authorized Use
SchoolCam is intended for use by:
• Schools and school districts
• Teachers and authorized school staff
• Other individuals authorized by an educational institution
The Service is not intended for children under 13 to independently create accounts.
If student users are granted access by a school, such access must be authorized and supervised by the educational institution.
By using the Service, you represent and warrant that:
• You are authorized by your school or organization to use the Service
• You are of legal age to enter into a binding agreement
• You will comply with all applicable laws, regulations, and school policies
Authentication and Access
SchoolCam does not require users to create a separate username or password.
Access to the Service is provided exclusively through authentication with a school-provided Google Workspace account (or another supported institutional authentication method, where applicable).
Users must:
• Log in using their official school-issued Google account
• Be authorized by their educational institution to use the Service
• Comply with their school’s internal IT and acceptable use policies
SchoolCam does not create independent consumer accounts and does not maintain separate login credentials outside the school’s authentication provider.
Access to the Service may be restricted or revoked if:
• The user’s Google Workspace access is suspended or removed by the school
• The educational institution terminates its use of SchoolCam
• The user violates these Terms
Role of the School – Data Control
In most cases, the educational institution using SchoolCam acts as the data controller for any personal data (including student photos) processed through the Service.
Bitwise Software acts solely as a technology provider and does not determine:
• Which photos are captured
• How photos are used
• How long photos are retained
• Who has access to them
Because authentication occurs through the school’s Google Workspace environment, access to SchoolCam is controlled by the educational institution. Schools are responsible for managing user permissions, account provisioning, and revocation of access within their Google Workspace domain.
Schools are responsible for ensuring their use of SchoolCam complies with applicable privacy laws, including but not limited to:
• The General Data Protection Regulation (GDPR)
• FERPA (Family Educational Rights and Privacy Act)
• COPPA (Children’s Online Privacy Protection Act)
• Any other applicable local or national regulations
Payments and Subscriptions
Certain features of SchoolCam may require a paid subscription.
If a school or user purchases a subscription:
• Fees are billed in advance on a monthly or annual basis
• Subscriptions automatically renew unless cancelled
• You authorize us to charge your selected Payment Method
Unless required by applicable law, subscription fees are non-refundable.
Subscription management and cancellations for mobile purchases must be handled through the applicable app store (Apple App Store or Google Play).
User Responsibilities and Acceptable Use
You are responsible for maintaining the confidentiality of your school-issued Google account credentials and for restricting access to your device while logged into SchoolCam. All activities performed while authenticated through your school account are your responsibility.
You are solely responsible for all content captured or uploaded using the Service.
You agree not to use SchoolCam to:
• Violate any applicable law or regulation
• Infringe intellectual property rights
• Upload unlawful, harmful, abusive, defamatory, or otherwise objectionable content
• Attempt unauthorized access to the Service
• Interfere with the integrity or performance of the Service
• Use automated systems (robots, scrapers, crawlers) to access the Service
We reserve the right to suspend access for violations of these Terms.
Third-Party Services
SchoolCam integrates with third-party services such as Google Drive and Google Workspace.
Your use of those services is subject to their respective terms and privacy policies. Bitwise Software is not responsible for:
• The availability or performance of third-party services
• Changes made by third-party providers
• Data handling practices of third-party services
Any data stored within Google Drive is subject to Google’s infrastructure, security, and retention policies.
Intellectual Property
All rights, title, and interest in and to the SchoolCam application, branding, software, and related materials remain the exclusive property of Bitwise Software, SL.
You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
You may not:
• Copy, modify, distribute, or create derivative works of the Service
• Reverse engineer or attempt to extract source code
• Resell or commercially exploit the Service without written permission
Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.”
To the maximum extent permitted by law, Bitwise Software disclaims all warranties, express or implied, including but not limited to:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
We do not guarantee that the Service will meet all regulatory, institutional, or compliance requirements. Educational institutions are responsible for evaluating suitability for their specific needs.
Limitation of Liability
To the maximum extent permitted by law, Bitwise Software shall not be liable for:
• Indirect, incidental, consequential, or punitive damages
• Loss of data stored in third-party services
• Service interruptions caused by third-party providers
Our total aggregate liability arising out of or relating to the Service shall not exceed the amount paid by the customer in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply.
Indemnification
You agree to indemnify and hold harmless Bitwise Software, its officers, directors, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:
• Your use of the Service
• Your violation of these Terms
• Your violation of applicable laws or third-party rights
Termination
We may suspend or terminate access to the Service if:
• You violate these Terms
• Required by law
• The Service is discontinued
Termination does not affect media files already stored within the school’s Google Drive account. Bitwise Software does not delete or control files stored in third-party cloud storage accounts.
Governing Law
These Terms are governed by the laws of Spain.
The parties submit to the jurisdiction of the courts of Barcelona, Spain.
For EU consumers, disputes may be submitted through the European Commission’s Online Dispute Resolution platform:

Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
