Privacy Policy

This Privacy Policy describes how Bitwise Software SL (“we”, “us”, or “our”) processes personal data in connection with the SchoolCam mobile and web application (the “Application”).

SchoolCam is designed to enable schools and educational institutions to capture photos and videos and upload them directly to a Google Drive account designated and controlled by the school.

Roles Under Data Protection Law

For photos and videos captured and uploaded using the Application:

• The school or educational institution using SchoolCam acts as the Data Controller, as it determines the purposes and means of processing student and staff data.

• Bitwise Software SL acts as a Data Processor, providing the technical infrastructure that enables direct transmission of files to the school’s Google Drive environment.


Bitwise Software SL does not determine how the school uses, stores, shares, or retains uploaded photos or videos.

File Storage Architecture

SchoolCam does not store photos or videos on servers operated by Bitwise Software SL.


Files captured or imported through the Application are transmitted directly from the user’s mobile device to the school’s designated Google Drive account.


Bitwise Software SL does not retain copies of uploaded photos or videos. All such files are stored exclusively within the school’s Google Workspace environment and are subject to Google’s privacy and security policies.

Information We Collect

To operate and maintain the Application, we process limited technical and account-related information, including:

• User email address (used as a unique identifier)

• IP address

• Device type and operating system

• Application usage data

• Error logs and diagnostic data

• File identifiers and upload timestamps (for operational purposes)

This information is processed solely to:

• Provide and maintain the Application

• Authenticate users

• Ensure system security

• Support troubleshooting and technical diagnostics

• Improve performance and reliability


We do not store photos or videos uploaded through the Application.

Legal Basis for Processing (GDPR)

Under the General Data Protection Regulation (GDPR), we process personal data on the following legal bases:

• Performance of a contract (Article 6(1)(b)) – to provide the Application to schools and authorized users.

• Legitimate interests (Article 6(1)(f)) – to maintain security, improve functionality, and ensure reliable operation of the Application.

• Compliance with legal obligations (Article 6(1)(c)), where applicable.


For student photos and related content, the school acts as Data Controller and determines the lawful basis for processing.

Location and Photo Metadata

SchoolCam does not independently collect or store location tracking data.

If a user enables location services on their device, location metadata may be embedded in the image file itself. Such metadata is stored only within the school’s Google Drive account as part of the image file.


Bitwise Software SL does not extract, store, or process GPS coordinates or location tracking information in its own systems.

Third-Party Services

We may use third-party service providers to support the operation of the Application (such as analytics, hosting, or infrastructure providers). These providers may process limited technical data on our behalf under appropriate contractual safeguards.

When using Google Drive, data is stored within the school’s Google Workspace environment and governed by Google’s privacy and security policies.

We may disclose personal data if required to do so by law or to protect legal rights.

Data Retention

We retain account-related and technical data only for as long as necessary to:

• Provide the Application

• Fulfill contractual obligations

• Comply with legal requirements

• Resolve disputes and enforce agreements


Photos and videos uploaded via SchoolCam are stored exclusively within the school’s Google Drive account and are retained according to the school’s own data retention policies.


Upon termination of a school account, associated account and operational metadata is deleted or anonymized within a reasonable period, unless legal obligations require longer retention.

Data Subject Rights (EU/EEA)

If you are located in the European Union or European Economic Area, you have the right to:

• Request access to your personal data

• Request correction of inaccurate data

• Request deletion of your data

• Request restriction of processing

• Object to processing

• Request data portability

• Lodge a complaint with your local supervisory authority


Requests concerning student photos or school-managed content should be directed to the relevant school, as the school acts as Data Controller for that data.

Children’s Data

SchoolCam is intended for use by schools and authorized staff members.

The Application is not intended for direct use by children. Schools are responsible for ensuring that appropriate parental consent or other lawful basis is obtained for the collection and use of student data.

Data Security

We implement appropriate technical and organizational measures to protect personal data, including encryption in transit, secure authentication mechanisms, and access controls.

United States Education Privacy Compliance

SchoolCam is designed to support compliance with applicable United States student privacy laws.

FERPA


SchoolCam operates as a “school official” with a legitimate educational interest under the Family Educational Rights and Privacy Act (FERPA).


The school or educational institution retains direct control over all student education records, including photos and videos stored within its Google Drive environment. Bitwise Software SL processes data solely on behalf of the school and does not use such data for any independent purpose.


COPPA


SchoolCam is intended for use by schools and authorized staff members. The Application is not marketed directly to children. To the extent that student data is processed in connection with educational activities, the school provides any necessary parental consent in accordance with the Children’s Online Privacy Protection Act (COPPA).

No Sale of Student Data


Bitwise Software SL:

• Does not sell student data.

• Does not use student data for targeted advertising.

• Does not create commercial profiles of students.

• Uses data solely to provide and maintain the Application.

Changes to This Policy

We may update this Privacy Policy from time to time. Updates will be published at:

Continued use of the Application after updates are posted constitutes acceptance of the revised Privacy Policy.
